It's Time Again for Employers to Comply with Year End Obligations and Prepare for the New Year

As we remind our readers each year, as year-end approaches, business owners need to remain mindful of their year-end human resources compliance obligations and prepare for upcoming minimum wage increases.

Minimum Wage Increases

New Jersey

Effective January 1, 2024, the New Jersey minimum wage will increase as follows:

  • $15.13 per hour for most employers.

  • $13.73 per hour for seasonal and employers with less than six employees.

  • $5.26 per hour with a tip credit of $9.87 per hour for tipped employees.

  • $12.81 per hour for agricultural employees.

  • 18.13 per hour for long-term facility staff.

New York

Effective January 1, 2024, New York's minimum wage will increase as follows:

  • $16 per hour for all employers in New York City, Long Island, and Westchester county.

  • $15 per hour for employers in the remainder of the state.

Additionally, effective March 13, 2024, the salary basis requirement for executive, administrative, and professional exemptions from overtime increases to $1,300 per week (up from $900).

 New Jersey Employee Notices

Employers in New Jersey with 50 or more employees must provide each employee with Gender Equity Notices by December 31, 2023. This is an annual requirement and employers must obtain acknowledgments of receipt from each employee. The form Gender Equity Notice can be found here.

New Jersey employees with 10 or more employees should issue their annual notices under New Jersey's whistleblower law, the Conscientious Employee Protection Act (CEPA), which can be found here.

Failure to comply with any of these requirements could expose an employer to fines or liability.
