Employers, Don't Forget Your Year End Obligations

As we remind our readers each year, as year-end approaches, business owners need to remain mindful of their year-end human resources compliance obligations and prepare for upcoming minimum wage increases.

Minimum Wage Increases

New Jersey

Effective January 1, 2022, the New Jersey minimum wage is increasing from $12 to $13 an hour for most employers. Seasonal and employers with less than six employees will be required to pay a minimum wage of $11.90 an hour (up from $11.10).

New York

Starting in December 31, 2021, New York's minimum wage remains $15 for all employers in New York City, Long Island, and Westchester county. The minimum wage for the remainder of the state increases to $13.20 per hour.

 New Jersey Employee Notices

Employers in New Jersey with 50 or more employees must provide each employee with Gender Equity Notices by December 31, 2021. This is an annual requirement and employers must obtain acknowledgments of receipt from each employee. The form Gender Equity Notice can be found here.

New Jersey employees with 10 or more employees should issue their annual notices under New Jersey's whistleblower law, the Conscientious Employee Protection Act (CEPA), which can be found here.

Failure to comply with any of these requirements could expose an employer to fines or liability. 

New York COVID-19 Issues

In addition to normal year-end issues, employers in New York also need to navigate New York’s recent COVID-19 requirements. Effective December 13, 2021, New York required that all businesses require proof of vaccination or mandate masks, regardless of vaccination status, in any indoor public place, through January 15, 2022. The State’s frequently asked questions regarding this mandate can be found here.

In addition, New York City Mayor DeBlasio has announced that effective December 27, 2021, private employers will be required to mandate vaccines for their employers. Guidance regarding this mandate is set to be issued on December 15, 2021. Incoming Mayor Adams has not indicated whether or not he will continue this mandate when he takes office in January.
