New Jersey Department of Labor Creates the “WALL” to List Businesses that Have Violated State Wage and Tax Law

On August 8, 2023, the New Jersey Department of Labor (NJDOL) launched the Workplace Accountability in Labor List, known as the “WALL.” Starting in September 2023, the NJDOL will post a list of businesses on the WALL that have outstanding liabilities for state wage, benefit, or tax laws enforced by the NJDOL. The WALL will be updated monthly.

Liabilities that can result in a business being listed on the WALL include liabilities for unpaid employee wages or sick leave, or tax contributions for unemployment, temporary disability, or family leave insurance. The NJDOL can list a business on the WALL only after issuance of a final judgment or order.

The creation of the WALL is part of New Jersey’s push to punish employers that violate New Jersey’s wage, tax, and employee benefits laws, which we have previously written about. Given the NJDOL’s continuing active efforts to enforce the state’s employment laws, and the extremely pro-employee nature of the state’s laws, businesses should work with knowledgeable counsel to ensure compliance with New Jersey’s numerous employment laws.
